California's Assembly Bill 3056

AMA Government Relations--California's Assembly Bill 3056, a bill that would halt the prohibition of street-licensed motorcycles in Community Interest Developments (CID), passed favorably out of the Senate Housing and Land Use Committee on July 1.

Having already passed the full Assembly, this bill has one more stop before it reaches the Governor's desk--the senate floor. We expect a full Senate vote on AB-3056 to take place either August 5 or August 8. We continue to need calls and letters of support to be directed toward California Senate members as well as Governor Wilson.

In California, we have seen discrimination against motorcyclists in many forms, but none more aggravating than policies that deny motorcycle access to individual homes in private communities. The American Motorcyclist Association (AMA) has worked diligently to get this legislation introduced and moved through the legislature. AB-3056 would halt the prohibition of street-legal motorcycles in private communities and permit homeowners to ride to and from their homes.

As you write and make your phone calls, here are some points you may want to make:

1. AB-3056 applies only to street-licensed motorcycles in full conformance with all requirements of the California Vehicle Code.

2. AB-3056 will not affect a community's ability to regulate parking or storage of any vehicle type.

3. Nothing in AB-3056 restricts a community from regulating or controlling loud or obnoxious vehicles of any type.

4. Motor vehicle policy is public policy. The authority to regulate motorcycles and ensure their suitability for use on the street appropriately rests with the state government. Policies regarding their use should be made by the legislature, not private developers.
