1        A bill to be entitled

2        An act relating to motorcycle riders; amending

3        s. 316.211, F.S.; exempting persons of a

4        specified age from certain safety equipment

5        requirements; requiring insurance coverage

6        under certain conditions; providing an

7        effective date.


9        Be It Enacted by the Legislature of the State of Florida:


11        Section 1. Subsection (3) of section 316.211, Florida

12        Statutes, is amended to read:

13        316.211 Equipment for motorcycle and moped riders.--

14        (3) This section shall not apply to persons riding

15        within an enclosed cab or to any person 16 years of age or

16        older who is operating or riding upon a motorcycle powered by

17        a motor with a displacement of 50 cubic centimeters or less or

18        is rated not in excess of 2 brake horsepower and which is not

19        capable of propelling such motorcycle at a speed greater than

20        30 miles per hour on level ground, or to persons over the age

21        of 21 years. In order to ride a motorcycle without wearing

22        protective headgear, a person over the age of 21 must obtain

23        bodily injury liability in the minimum amount of $20,000 per

24        person, $40,000 per accident, and medical payment coverage for

25        the driver and all passengers of at least $10,000 for the

26        driver and each person. The operator of the motorcycle must

27        have proof of insurance on his or her person in order to

28        operate the motorcycle and must provide proof of insurance

29        upon demand by any law enforcement officer.

30        Section 2. This act shall take effect July 1, 1998.



Exempts motorcycle riders over 21 years of age from
protective headgear and eye-protective device
requirements. Requires such persons to maintain certain
insurance coverage and to present proof of such coverage
upon demand by a law enforcement officer.
